Terms of service for using Lumialo.

The service
What Lumialo is. Lumialo runs an AI Visibility analysis on your brand. You give us a brand description, a brand name, and a list of competitors. We ask AI assistants (ChatGPT on the free plan; ChatGPT and Claude on the paid plan) a set of buyer-intent questions about your category, then email you a link to a report showing how those assistants describe your business and which competitors they mention. What Lumialo is not. Lumialo is a descriptive analysis tool, not an SEO ranking service, not a marketing-campaign manager, and not legal, financial, or business advice. We tell you what AI assistants are saying today — we do not execute any changes on your behalf, and we do not guarantee that following any pattern in a report will change what the assistants say tomorrow. Third-party AI providers. The analysis depends on OpenAI (ChatGPT) and Anthropic (Claude). If those providers are slow, rate-limit us, or are down, your analysis will be slower or retried, and if it cannot be completed we mark it failed and you are not charged for it. We do not control the providers and cannot guarantee their uptime or the wording of their answers. Eligibility. You must be at least 18 years old and able to enter a contract under the law of your country to use Lumialo.
Payments
Buying credits. $99 buys 1,000 credits. You pay the actual AI cost of each analysis. What an analysis costs depends mostly on how many questions it has and how much AI help you use while defining it. Your first purchase is at least $99; after that you can buy from $20 up to $500 at a time. No subscription, no auto-renew. How you are charged. You pay the actual AI cost of each analysis, converted to credits. Before you run, we show an estimate and check that your balance covers it. It's an estimate, not a price: you pay for the AI your analysis actually uses, so the final amount can be higher or lower. We show you the exact amount when the report is ready. If the analysis uses more than your balance, your balance goes below zero and your next purchase covers it first. Credit validity. Credits are valid for 1 year from purchase. Credits are non-transferable and non-cash; they have no monetary value outside Lumialo. Payment processing. Payments are processed by Stripe. We do not see, store, or have access to your full card number — Stripe handles that.
Refunds
Refunds. We do not refund credits. An analysis that fails is not charged, except one we stop because its cost ran far above its estimate: then you pay for the work done.
Liability
Provided as-is. The service is provided on an "as-is" and "as-available" basis. We do our best to keep it reliable and the analyses accurate, but we make no warranty that the service will be uninterrupted, error-free, or that any specific result — including but not limited to ranking signals, competitor intelligence, recommendations, or projected outcomes — will be produced. What we are not liable for. We are not liable for indirect, incidental, consequential, or special damages, including but not limited to lost profits, lost revenue, lost data, business interruption, reputational loss, or costs of substitute services, arising from your use of the service. We are not liable for the wording, accuracy, or availability of answers from third-party AI providers (OpenAI, Anthropic). This includes but is not limited to bias, hallucination, or refusal, nor changes those providers make to their own services. Cap on liability. To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the service is capped at the total amount you paid us in the twelve months before the event giving rise to the claim. Business use. Lumialo is a business-to-business service. It is sold for use in your trade, business or profession, and is not aimed at consumers. By using Lumialo you confirm that you are using it for business purposes. Where mandatory law still gives you rights that cannot be waived, nothing in these Terms removes them.
Governing law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of Denmark. The courts of Copenhagen, Denmark have non-exclusive jurisdiction to settle any such dispute. If any part of these Terms is found to be unenforceable, the rest of the Terms remain in force.
Changes to these terms
We may update these Terms from time to time — for example when we add new features, change prices, or are required to clarify something for legal reasons. How you will know. The "Last updated" date at the top of this page always shows when the current version took effect. If a change materially affects your rights or obligations, we also email the address on your account. Smaller edits — typos and clarifications — are reflected only in the "Last updated" date. Credits you have already bought. A change to these Terms does not change credits already in your account: they keep the balance and the validity they had when you bought them. If you do not agree with the updated Terms, you can stop using the service. Continued use. If you keep using Lumialo after a change takes effect, you accept the updated Terms.
