Terms of service for using Lumialo.

The service
What Lumialo is. Lumialo runs an AI Visibility analysis on your brand. You give us a brand description, a brand name, and a list of competitors. We ask AI assistants (ChatGPT on the free plan; ChatGPT and Claude on the paid plan) a set of buyer-intent questions about your category, then email you a report showing how those assistants describe your business and which competitors they mention. What Lumialo is not. Lumialo is a descriptive analysis tool, not an SEO ranking service, not a marketing-campaign manager, and not legal, financial, or business advice. We tell you what AI assistants are saying today — we do not execute any changes on your behalf, and we do not guarantee that following any pattern in a report will change what the assistants say tomorrow. Third-party AI providers. The analysis depends on OpenAI (ChatGPT) and Anthropic (Claude). If those providers are slow, rate-limit us, or are down, your analysis will be slower, retried, or in some cases refunded — see Refunds below. We do not control the providers and cannot guarantee their uptime or the wording of their answers. Eligibility. You must be at least 18 years old and able to enter a contract under the law of your country to use Lumialo.
Payments
Credit packs. The paid plan is priced as credit packs. The default pack is $99 (or local-currency equivalent) for 1,000 credits. One full end-to-end analysis on the paid plan is calibrated to cost roughly 100 credits, so a default pack covers around ten full runs. The credits consumed by an analysis depend on how it's configured (number of competitors, question groups, and questions). The estimate is shown before you submit. Credit validity. Credits are valid for one year from the date of purchase. Credits are non-transferable and non-cash; they have no monetary value outside Lumialo. Payment processing. Payments are processed by Stripe. We do not see, store, or have access to your full card number — Stripe handles that. Your receipt comes from Stripe and contains the legal information required for your accounting. Taxes. Prices are shown excluding VAT. If you are an EU consumer, VAT may be added at checkout where required by law. Business buyers can provide a valid VAT number at checkout if applicable.
Refunds
Refunds. If Lumialo cannot deliver the full analysis you paid for — for example, if part of the run fails or our recommendations engine cannot complete — we refund the credits that were not actually used to complete your run. Refunds are issued automatically to your credit balance within minutes of the failure. We do not refund credits for completed analyses, including analyses you later disagree with. If you believe a refund was calculated incorrectly, email privacy@lumialo.com within 30 days and we will review the underlying API-cost record. Five-recommendation guarantee. Every paid report aims to ship at least five evidence-checked recommendations. If our validation checks (the six rules listed on the methodology page) produce fewer than five valid recommendations after our generator retries, Lumialo withholds the recommendations section, marks the report with a "Limited recommendations this run" banner, and refunds the credits attributable to the recommendation step automatically to your credit balance. This refund is in addition to any incomplete-analysis refund above. The rest of the report — score, competitor comparison, visibility by topic group, questions where you are absent, and the per-question CSV — is delivered as normal; the held-recommendations refund is a partial refund of the recommendation step only, not the whole run. Manual refunds. If something has gone wrong and the automatic refunds above do not cover it, email hello@lumialo.com and we will look at it case by case. We process manual refunds through the Stripe dashboard back to the original payment method. Outside these cases. Beyond the cases above, credit packs are non-refundable once credits have been used. Unused credits within 14 days of purchase can be refunded at our discretion if you ask — credits that have been spent on completed analyses cannot.
Liability
Provided as-is. The service is provided on an "as-is" and "as-available" basis. We do our best to keep it reliable and the analyses accurate, but we make no warranty that the service will be uninterrupted, error-free, or that any specific result — including but not limited to ranking signals, competitor intelligence, recommendations, or projected outcomes — will be produced. What we are not liable for. We are not liable for indirect, incidental, consequential, or special damages, including but not limited to lost profits, lost revenue, lost data, business interruption, reputational loss, or costs of substitute services, arising from your use of the service. We are not liable for the wording, accuracy, or availability of answers from third-party AI providers (OpenAI, Anthropic). This includes but is not limited to bias, hallucination, or refusal, nor changes those providers make to their own services. Cap on liability. To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the service is capped at the total amount you paid us in the twelve months before the event giving rise to the claim. Consumer rights. Nothing in these Terms removes or limits any non-waivable rights you have as a consumer under the law of your country of residence.
Governing law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of Denmark. The courts of Copenhagen, Denmark have non-exclusive jurisdiction to settle any such dispute. If you are an EU consumer, this does not remove your right to bring proceedings in the courts of your country of residence where mandatory consumer-protection law gives you that right. If any part of these Terms is found to be unenforceable, the rest of the Terms remain in force.
Changes to these terms
We may update these Terms from time to time — for example when we add new features, change prices, or are required to clarify something for legal reasons. How you will be notified. When we make a change that materially affects your rights or obligations, we update the "Last updated" date at the top of this page and send a notice to the email address on your account at least 30 days before the change takes effect. Smaller, non-material edits (typos, clarifications) are reflected only via the "Last updated" date. Grace period. During the 30-day notice period the previous Terms continue to apply. If you do not agree with the updated Terms you can stop using the service and request a refund of any unused credit pack purchased within the previous 14 days. Continued use. If you keep using Lumialo after the change takes effect, you accept the updated Terms.
